In order to purchase the goods you like in the online shop www.myliusvara.lt, please read these rules, which are the contract of sale and purchase, setting out the mutual rights, obligations and responsibilities between the seller and the buyer.
The contract between the Online Shop and the Buyer shall be deemed to be concluded from the moment the Buyer, after having created a shopping cart, indicated the delivery address and chosen the payment method of the order, clicks on the “Pay” button and the Online Shop sends the Buyer a confirmation of the order confirmation to the e-mail address indicated by the Buyer. All Contracts are stored in the database of the Online Shop(www.myliusvara.lt).
3.1. The Buyer has the right to make purchases in the Online Shop in accordance with these Rules and the legislation of the Republic of Lithuania.
3.2. Natural persons and legal entities who have reached the age of majority are entitled to purchase goods in the Online Shop.
3.3. Minors aged between 14 and 18, only with the consent of their parents or guardians, unless they are self-reliant.
3.4. The authorised representatives of all of the above persons shall also be entitled to be the Purchaser.
3.5. The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment the Buyer, after having created a shopping cart in the e-shop, indicated the delivery address, chosen the payment method and read the Seller’s rules, clicks on the “Confirm Order” button.
3.6. The Buyer has the right to withdraw from the ordered goods and the Contract by notifying the Online Shop in writing within 7 working days from the date of delivery of the goods, in accordance with the Order of the Minister of Economy of the Republic of Lithuania No. 258 of 17 August 2001 “On the Approval of the Rules of the Sale of Goods and Provision of Services when Contracts are Concluded by Means of Communication”.
4.1. Accept the goods ordered in the Online Shop and pay the agreed price for the goods and their delivery using the payment methods provided in the Online Shop (Online Banking or Cash on Delivery).
4.2. If the data provided in the Buyer’s registration form changes, the Buyer must update it without delay.
4.3. The Customer undertakes not to pass on his/her login data to third parties. If the Buyer loses his/her login data, he/she must immediately inform the Seller by the means of contact indicated in the “Contact” section.
4.4. By using the e-shop, the Buyer agrees to these Terms and Conditions of Purchase and undertakes to comply with them and not to violate the legislation of the Republic of Lithuania.
5.1. The Seller undertakes to provide all the conditions for the Buyer to make proper use of the services provided by the e-shop.
5.2. If the Customer attempts to interfere with the operation of the Online Shop, the Online Shop may suspend or restrict access to its services.
5.3. The Online Shop has the right to suspend or terminate its activities and to change its rules without notice to Customers.
5.4. The Seller undertakes to respect the Buyer’s right to privacy with respect to the Buyer’s personal information provided in the e-shop registration form.
5.5. In the event of difficult circumstances, if the Online Shop is unable to deliver the goods ordered by the Buyer, it undertakes to offer similar goods and, if the Buyer refuses, to refund the money paid.
5.5. If the Buyer does not pay for the goods by bank transfer, the order will be cancelled within 5 working days. The order is paid when the Online Shop’s bank account contains the full amount of the Buyer’s payment for the goods purchased.
5.6. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer within the time allowed for this purpose.
6.1. The goods are delivered by an authorised representative of the Online Shop (Venipak and Omniva).
6.2. Goods are delivered to the Buyer within 2-4 working days from the payment of the order, throughout Lithuania, Latvia.
6.3. The Buyer undertakes to specify the exact place of delivery of the goods by selecting the delivery service at the time of ordering.
6.4 We deliver the Goods from door to door with the help of Venipak couriers.
6.5. The Buyer undertakes to accept the goods himself. In the event that the Buyer is unable to take delivery of the goods himself and the goods are delivered to the address indicated, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong entity.
6.6. The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods. These time limits are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. The Buyer also agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such case, the Seller undertakes to contact the Buyer immediately to agree on the terms of delivery.
6.7. Goods are delivered free of charge for purchases of 30€ and more throughout Lithuania and Latvia (except for the municipality of Nerja). For orders of less than €30, a delivery fee of €5.00 applies. Goods are not delivered to the Municipality of Neringa.
6.8. At the time of delivery of the goods, the Buyer must inspect the goods received together with an authorised representative of the Online Shop and compare them with the Invoice. Upon delivery of the order to the courier, the Buyer must check the packaging for damage. Once the Buyer has signed the Invoice, the order shall be deemed to have been delivered and the Buyer shall have no claim against the Online Shop.
6.9. The Buyer must in all cases immediately inform the Seller if the consignment is delivered in damaged or otherwise defective packaging, if the consignment contains unordered goods or the wrong quantity of goods, or if the consignment is not complete.
6.10. In all cases, if the Buyer notices any damage to the packaging at the time of delivery, the Buyer must make a note of the damage on the delivery note provided by the courier, or draw up a separate report of the damage. The Buyer must do so in the presence of the courier. Failure to do so shall exempt the Seller from liability to the Buyer in respect of any damage to the goods in relation to damage to the packaging not noted by the Buyer in the courier’s delivery note.
6.11. In all cases, the Seller shall be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
7.1. Returns are made in accordance with 29 June 2001. 217 “On the Approval of the Rules for the Return and Exchange of Goods”, approved by the Minister of Economy of the Republic of Lithuania, except in cases where the contract cannot be withdrawn from in accordance with the laws of the Republic of Lithuania (in the case of a contract for the sale of hygiene products – bed linen; see the information available on the website of the Public Institution “Consumers’ Centre” at www.vartotojucentras.lt, under point 18, “Specifics of the Return and Exchange of Non-food Goods”). In all cases, money for returned goods shall be paid only to the payer’s bank account.
7.2. Goods that the Buyer does not like due to shape, size, colour, model, completeness (except for the exceptions provided for by the legislation of the Republic of Lithuania) shall be accepted from the Buyer and replaced within 15 days from the date of return of the goods to the Online Shop. 7.3. Goods must be returned in the packaging in which they were delivered. The packaging must be intact, clean, properly prepared and packaged. You must provide proof of purchase when returning the goods.
7.4. In the event that the Seller does not have goods suitable for replacement, the Buyer shall be refunded the amount paid, exclusive of the delivery charge.
8.1. The Buyer is fully responsible for the accuracy of the data provided in the registration form. The Online Shop shall not be liable for any consequences resulting from the lack of the Buyer’s precise data in the registration form.
8.2. The Buyer is fully responsible for his/her actions when using the Online Shop with his/her login details. You remain liable for the actions you take if your login details are passed on to a third party.
8.3. The Online Shop is not responsible for the information provided on other websites, even if the Buyer is directed to these pages via links provided in the Online Shop.
8.4. In the event of damage, the party at fault shall indemnify the other party in accordance with the law of the Republic of Lithuania.
9.1. The Online Shop sends the information to the Buyer by email to the email address specified in the registration data. The contacts for the online shop are listed in the “Contacts” section.
9.2. The Seller may, at its sole discretion, initiate an e-shop. in-store promotions.
9.3. The Buyer’s data shall be stored in accordance with the Personal Data Protection Law of the Republic of Lithuania and other legal acts regulating the collection of such data.
9.4. The Seller shall not be liable if the Buyer does not receive the information or confirmation messages sent due to disruptions in the networks of the internet connection, email service providers.
10.1. These Terms and Conditions of Sale and Purchase of Goods have been drawn up in accordance with the laws and regulations of the Republic of Lithuania.
10.2. Any disagreements arising from the application of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
