Terms and conditions of use

1. General provisions.

If you wish to purchase goods in Online Store https://myliusvara.lt/en/, please read the following rules which are a purchase-sale contract laying down the rights, obligations and liability between the seller and the buyer.

 

2. Conclusion of the contract.

The contract between the Online Store and the Buyer is deemed to be concluded from the moment the Buyer has formed a shopping cart, has specified the delivery address of the goods and has selected the payment method of the order, and clicks button “Pay” and the Online Store sends the order confirmation to the e-mail address specified by thee Buyer. All Contracts are stored in the database of the Online Store (https://myliusvara.lt/en/).

 

3. Rights of the Buyer.

3.1. The Buyer has the right to purchase in the Online Store in accordance with these Rules and the legal acts of the Republic of Lithuania.

3.2. Natural persons who have reached the age of majority and legal entities are entitled to purchase goods in the Online Store.

3.3. Minors aged between 14 and 18 years of age only with the consent of their parents or guardians, except where they have their own income at their disposal.

3.4. The authorised representatives of all the above persons also have the right to be the Buyer.

3.5. The contract between the Buyer and the Seller is deemed to be concluded from the moment the Buyer has formed a shopping cart in the e-shop, has specified the delivery address, has chosen the payment method and has familiarised with the Seller’s rules, and clicks button “Confirm order”.

3.6. The Buyer has the right to cancel the ordered goods and the Contract by notifying the Online Store in writing within 7 working days from the date of delivery of the goods in accordance with Order No 258 of the Minister of Economy of the Republic of Lithuania of 17 August 2001 “On the Approval of the Rules on the Sale of Items and Provision of Services when Contracts are Concluded by Means of Communication”.

 

4. The Buyer undertakes to:

4.1. accept the goods ordered in the Online Store and pay the agreed price for them and their delivery using the payment methods provided for in the Online Store (online banking or cash at delivery).

4.2. In the event of any changes in the data provided in the Buyer’s registration form, the Buyer must update them immediately.

4.3. The Buyer may not transfer the login data of the Buyer to any third parties. In the event of the loss of the login data, the Buyer must immediately inform the Seller about this by the means of communication specified in Section “Contacts”.

4.4. By using the e-shop, the Buyer agrees to these Purchase-Sale Rules and undertakes to comply with them and not to violate the legal acts of the Republic of Lithuania. 

 

5. Rights and obligations of the Online Store.

5.1. The Seller ensures all conditions for the Buyer to properly use the services provided by the e-shop.

5.2. If the Buyer attempts to undermine the operation of the Online Store, the Online Store may suspend or restrict access to its services.

5.3. The Online Store has the right to suspend or terminate its activities and change the rules without notifying the Buyers.

5.4. The Seller undertakes to respect the Buyer’s right to privacy with regard to the Buyer’s personal information specified in the e-shop registration form.

5.5. In the event of emergence of difficult circumstances when the Online Store is unable to deliver the goods ordered by the Buyer, the Online Store undertakes to offer similar goods and to return the money paid if the Buyer refuses them.

5.5. If the Buyer chooses to pay for the goods by transfer to the bank account and fails to pay the order within 5 working days, the order is cancelled. The order is deemed paid when the bank account of the Online Store has the total amount for the goods purchased by the Buyer.

5.6. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer within the time limits specified for this purpose.

 

6. Delivery of the goods.

6.1. The goods are delivered by the authorised representative of the Online Store (Venipak and Omniva).

6.2. The goods are delivered to the Buyer within 2-4 working days from the date of payment of the order throughout Lithuania, Latvia.

6.3. The Buyer who chooses the delivery service at the time of the placement of the order, undertakes to indicate the exact place of delivery of the goods.

6.4 We deliver goods from door to door with the help of Venipak couriers.

6.5. The Buyer undertakes to accept the goods personally. In case the Buyer cannot accept the goods personally and the goods are delivered to the specified address, the Buyer does not have the right to submit any claims to the Seller regarding the delivery of the goods to the wrong subject.

6.6. The Seller delivers the goods to the Buyer in accordance with the time limits specified in the descriptions of the goods. These time limits are preliminary, besides, they do not apply in the cases where the Seller’s warehouse does not have the required goods and the Buyer is notified about the shortage of the ordered goods. At the same time, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to contact the Buyer immediately and agree on the terms and conditions of delivery of the goods.

6.7. The goods are delivered free of charge throughout Lithuania and Latvia (except the Municipality of Neringa) if the Buyer acquired the goods in the amount of EUR 30 and more. If the amount of the order is less than EUR 30, a delivery fee of EUR 5.00 applies. No goods are delivered to the Municipality of Neringa.

6.8. At the time of delivery of the goods, the Buyer must check the received goods together with the authorised representative of the Online Store and compare them with the Invoice. Upon delivery of the order by the courier, the Buyer must check whether the package is not damaged. After the Buyer has signed the Invoice, the order is deemed to have been transferred and the Buyer has no claims to the Online Store.

6.9. The Buyer must in all cases immediately inform the Seller if the shipment is presented in a damaged or otherwise broken packaging, if the shipment contains unordered goods or incorrect quantities, or if the set of goods is not complete.

6.10. In all cases, if the Buyer notices any damages of the packaging at the time of delivery, the Buyer must either enter the comments in the delivery document provided by the courier or draw up a separate report regarding such violations. The Buyer must do this in the presence of the courier. In the absence of such actions, the Seller is released from liability towards the Buyer for the damaged goods relating to the damaged packaging that have not been marked by the Buyer in the delivery document provided by the courier.

6.11. In all cases, the Seller is released from liability for the breach of the time limits for the delivery of the goods if the goods are not delivered to the Buyer or are delivered beyond the time limits due to the fault on the part of the Buyer or due to circumstances beyond the Seller’s control.

 

7. Return of the goods.

7.1. The goods are returned in accordance with the Rules of Return and Exchange of Items as approved by Order No 217 of the Minister of Economy of the Republic of Lithuania of 29 June 2001 “On the Approval of the Rules of Return and Exchange of Items”, except in the cases where the contract cannot be withdrawn in accordance with the laws of the Republic of Lithuania (when the contract is concluded for the sale of hygienic goods – bed linen supplies); see the information on the website of VšĮ “Vartotojų centras” at www.vartotojucentras.lt, paragraph 18 of “Specific Features of Return and Exchange of Non-Food Goods”). Money for the returned goods is in all cases transferred only to the payer’s bank account.

7.2. The goods that are not acceptable to the Buyer because of the shape, size, color, model, completeness (except for the cases provided for in the legal acts of the Republic of Lithuania) are accepted from the Buyer and replaced within 15 days from the date of return of the Goods to the Online Store. 7.3. The goods must be returned in the same packaging in which they were delivered. The packaging must be intact, clean, properly prepared and packaged. Return of the goods must be accompanied by a document evidencing their acquisition.

7.4. In case the Seller does not have the goods suitable for the replacement, the Buyer is refunded the amount paid less the delivery price.

 

8. Liability:

8.1. The Buyer is fully liable for the correctness of the data provided in the registration form. The Online Store is not liable for the consequences arising as a result of the lack of the accurate data of the Buyer in the registration form.

8.2. The Buyer is fully liable for the actions carried out while using the Online Store with the help of own login data. Liability for the actions remains even in the case of transfer of own login data to any third parties.

8.3. The Online Store is not liable for the information provided on other websites even if the Buyer enters such websites through the links available in the Online Store.

8.4. In the event of any damage, the faulty party will compensate the other party for the damage suffered in accordance with the law of the Republic of Lithuania.

 

9. Sending of information.

9.1. The Online Store sends the information to the Buyer by the e-mail address specified in the registration data. The contact details of the Online Store are listed in the Section “Contacts”.

9.2. The Seller may initiate various promotional campaigns in the e-shop at its own discretion.

9.3. The Buyer’s data is stored in accordance with the Republic of Lithuania Law on the Protection of Personal Data and other legal acts regulating the collection of such data.

9.4. The Seller is not liable if the Buyer does not receive any information or confirmation messages due to the disruption of the Internet connection or networks of e-mail service providers.

 

10. Final provisions.

10.1. These Rules for the purchase-sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.

10.2. Any disagreements arising from the implementation of these Rules are settled by way negotiations. If no agreement is reached, the disputes are resolved in accordance with the procedure laid down by the laws of the Republic of Lithuania.
